The Canada–United States tax treaty is the bilateral rulebook that allocates taxing rights and reduces double taxation for people and businesses with feet (or income) in both countries. It is not a loophole that deletes all tax, and it is not the same document as a LatAm territorial-tax pitch deck.
MLL readers usually hit the treaty from one of three angles: Canadians with US-source income or a US LLC, Canadians exiting Canadian tax residency while keeping US infrastructure, or dual-touchpoint families. This page is a practical map — not a full technical commentary. Pair it with ITIN from Canada and Escape Canada when those paths apply.

Important: IRS rules, bank KYC, credit underwriting, and treaty positions change. This is educational orientation — not tax, legal, immigration, or credit advice. Do not treat any example as a guarantee of approval, refund, or rate. Treaty positions depend on residency, income type, and documentation; get a qualified cross-border advisor for live claims.
What the Treaty Is For
At a high level, the treaty:
- Defines how dual-resident cases can be resolved (tie-breaker concepts)
- Allocates taxing rights over categories of income (business profits, dividends, interest, etc.)
- Provides mechanisms that, when properly claimed, reduce double tax
- Interacts with domestic law in both countries — it does not float free of CRA or IRS rules
Reading a single article online does not replace Form-level treaty disclosure when a return requires it.
Who Cares
- Canadians paid by US clients or platforms with US withholding questions
- Canadians who own a Wyoming LLC or other US entity
- People becoming non-resident of Canada while keeping US investments or entities
- Families with mixed Canada/US filing touchpoints
Residency and Tie-Breakers (High Level)
Tax residency is not “I moved last month, so I’m done.” Canada and the US each have domestic tests; when both would claim you, treaty tie-breaker concepts (permanent home, centre of vital interests, habitual abode, nationality, mutual agreement) can decide. The order and application are technical — do not self-declare via a Twitter thread.
An ITIN does not make you a US tax resident. A US LLC does not automatically end Canadian residency. Keep those switches separate.
Practical test we use in intake conversations: list where you sleep, where your family is, where your economic centre is, and which country’s domestic law already treats you as resident — then ask whether a treaty analysis is even the next step. Many people need a cleaner domestic residency break (or cleaner US filing) before treaty poetry helps.
ITIN and Filing Logistics
Treaty talk often shows up next to a practical problem: a Canadian needs a US taxpayer ID to file or to complete KYC. That is the ITIN path — process in how to get an ITIN, Canada-specific notes in ITIN from Canada, managed packaging at US ITIN Assistance.
Having a treaty argument does not remove the need for correct forms, withholding certificates where applicable, or personal identification numbers on returns.
Need Help With an ITIN Application or Renewal?
MLL’s remote CAA path packages Form W-7 without mailing your original passport for the standard managed route. Or book a call if your exception path is unclear.
Common Situations
- US LLC + living in Canada — entity filings vs personal filings; ITIN/EIN confusion is common.
- Leaving Canada — departure tax / residency break is a CRA problem set; US ITIN is optional infrastructure. See Escape Canada package.
- US-source passive income — withholding and treaty rates depend on income type and documentation.
- Remote work for a US company while in Canada — often more employment / PE / payroll analysis than “just get an ITIN.”
What the Treaty Does Not Do
- Does not erase all tax in both countries by default
- Does not replace domestic filing obligations when they still apply
- Does not grant US work authorization or immigration status
- Does not make an ITIN optional if a form still requires a US TIN

Where the ITIN sits in a treaty file
A treaty position is argued on a return and, when required, on the forms that go with it. The ITIN is the identifier the IRS uses for a person who cannot get an SSN. It is not a treaty election by itself.
Residency tie-breakers (home, center of vital interests, habitual abode, nationality) decide which country treats you as resident for treaty purposes. An LLC in Wyoming does not win that test. Canadians who wanted the LLC as an exit should read Escape Canada separately.

Frequently Asked Questions
Does the Canada–US treaty mean I do not need an ITIN?
No. Treaty positions and taxpayer identification are different problems. If a US return or KYC process requires a US TIN and you cannot get an SSN, you still need an ITIN.
Does an ITIN make me a US tax resident?
No. An ITIN is a processing number. Residency follows domestic and treaty tests.
Can MLL file my full cross-border return set from this article?
This page is education. Filing is a separate engagement via tax-return / CPA services when the facts fit.
Is the treaty the same as the US totalization / Social Security agreement?
No. Social Security totalization is a different instrument from the income-tax treaty. Do not mix them when planning.
Do I need a US ITIN to claim treaty benefits?
It depends on the form and the counterparty. Many US filing and withholding workflows still need a US TIN. Assume paperwork wants an ID even when a treaty rate is available.
